Section 377: A step towards Brighter Rainbow



Through ages our society have thought us to love someone who belongs to same caste , creed, religion and moreover that person should be of the opposite gender and his/her family should have same socio-economic status as yours. In India, liberty to choose your partner for life is in the hands of your parents. In this case loving someone who belongs to same gender ?The society will never accept this act. According to them this isn't love, this is a kind of disorder or disease faced by the youth of today’s generation.The decision follows a protracted struggle by activists and members of the community against the repressive law, introduced in 1861 when India was under British rule. It threatened imprisonment, even a lifetime sentence, and a fine for those who engaged in what it labeled as “unnatural offences” or intercourse “against the order of nature.” During this era being “homosexual” or “heterosexual” is considered to be the biggest sin.

"Why is it that, as a culture, we are more comfortable seeing two men holding guns than holding hands?",said Author Ernest J. Ga.

This is 21st century, like the world is progressing in terms of science and technology and in the same way slowly and steadily, the society is opening it's doors and welcoming the  modern age thinking the world is changing and so is our society !!

On September 6 2018, Supreme Court decriminalised the Section 377 of the IPC and allowed gay sex among consenting adults in private. The SC ruled that consensual adult gay sex is not a crime saying sexual orientation is natural and people have no control over it. 


Five Supreme Court judges Justice Dipak Misra, 
Justice Rohinton Fali Nariman, Justice A.M Khanwilkar, Justice D.Y. Chandrachud and Justice Indu Malhotra declared in a spectacular leap for gay rights in the country and a rainbow moment in it's history. The Supreme Court overruled its own 2013 decision and partially struck down Section 377, a controversial British-era law that banned consensual gay sex. The ban is irrational and indefensible ,"Take me as I am," said Chief Justice of India Dipak Misra, toasting gay pride.

This colonial-era law was first challenged by NGO Naz Foundation and AIDS Bedhbhav Virodh Andolan, in the Delhi High Court in 2001. However, both the petitions were dismissed in the court but nevertheless after years of struggle finally "The LGBTQ" Community witnessed the hope of brighter future.

The society is changing love is where both partners are comfortable and compatible with each other. Gender , Caste , Creed and religion shouldn’t be the big issue .
